A man who claims to be "sick" about his health has a surprising new lawsuit.
Tadalafil, the generic version of Cialis, can be prescribed to men suffering from benign prostatic hyperplasia (BPH). But the man, whose condition is now so severely debilitating he is in dire need of medical attention, is now suing his doctor for medical malpractice.
Dr. David Nissen, an urologist at Lenox Hill Hospital in New York City, said he has seen several men suffering from BPH, but he was skeptical about the potential cost of Cialis.
"I'm not going to get a price tag on it. I can't even get a prescription for it. I think this is a very expensive drug," Nissen said.
Nissen said a study has shown that men who took Cialis, when taken with other medications such as Viagra, had higher odds of developing BPH than those who took them alone. Those odds were higher for men who took an erectile dysfunction drug such as Viagra, a drug that treats impotence. But the drug was not shown to significantly reduce the risk of prostate cancer, he added.
Nissen said he will seek a similar remedy, which has not been approved by the U. S. Food and Drug Administration. The drug may be used in other ways, he said.
Nissen said he plans to appeal the lawsuit.
"I think it's a valid lawsuit. I'm in a very unique position to hold my patients to a high standard of care," Nissen said. "I think it is a very risky act."
A federal judge in Connecticut has taken up the matter with the New York Attorney General's office.
The lawsuit was filed on Friday in federal court in Boston. It was filed on March 18 in Boston's Eastern District.
The lawsuit was filed in Massachusetts, and the suit was transferred to the U. District Court for the Eastern District of New York.
The lawsuit is the latest in a series of lawsuits in the pharmaceutical industry that are pending against Eli Lilly and Co. and Bayer, which makes Cialis.
"We know there are very few treatments that are as effective as Cialis, and we know that Cialis is one of those," said Jim Turner, a spokesman for Eli Lilly, which makes the drug.
The FDA has said the drug was effective in treating erectile dysfunction, but it did not recommend a similar remedy in men with BPH.
John B. Smith, an epidemiologist and urologist with Boston's Mount Sinai Hospital, said he believed Cialis was safe for men who had BPH. But he said his patients were not being treated for the condition.
"The evidence suggests that Cialis is not a safe drug for those men, or a safe alternative, because Cialis does not appear to be a safe drug for men who are not on any other medications," he said.
The lawsuit says that erectile dysfunction drugs such as Cialis, Viagra, Levitra and Stendra are not safe for patients with BPH. The drug was originally developed for the treatment of erectile dysfunction, and it was later found to be effective in treating both disorders.
But some doctors said they believe there was a link between the drugs and BPH.
"We're having a conversation now about whether the drug is safe," said Dr. David A. E. Jones, an endocrinologist at the Cleveland Clinic.
But he added that he is not sure that there was a link between Cialis and BPH.
The lawsuit was filed in Massachusetts.
In June, the U. Judicial Panel on Multidistrict Litigation consolidated the lawsuits into a class action and a lawsuit for want of MADENIA V. JOHNSON and PAUL L. ENGEL.
Judge Charles B. Guilbert of the U. District Court for the Western District of New York in Boston ordered the proceedings to be heard by the end of the week.
